By using Twyk AI ("the Service", "we", "us"), you agree to these Terms of Service ("Terms"). The Service is operated by Twyk AI. If you do not agree, do not use the Service.
1. Service Description
Twyk AI is an AI content generation tool for Shopify merchants. The Service generates product summaries, benefit lists, product images, social media ad images, collection descriptions, and collection images using artificial intelligence. The Service is provided as a Shopify app and is accessible through the Shopify admin interface.
2. Eligibility
You must be at least 18 years old and operate a valid Shopify store to use the Service. By using the Service, you represent that you have the authority to bind yourself or the entity you represent to these Terms.
3. Account and Access
Access to the Service is provided through Shopify OAuth. You are responsible for maintaining the security of your Shopify account. You must not share your access or allow unauthorized third parties to use the Service through your account.
4. Credits and Billing
- Credits are a virtual unit used to measure Service usage. Credits are not currency, have no monetary value, and cannot be exchanged, transferred, or converted back to money.
- Credit purchases are final and non-refundable. This includes subscription plans, one-time credit purchases ("Buy Credits"), and any other paid features.
- Credits expire 6 months after purchase. Unused credits are forfeited upon expiration.
- Subscription plans renew automatically every 30 days through Shopify billing. You can cancel at any time through the Shopify admin. Cancellation takes effect at the end of the current billing cycle.
- Credit costs per generation are estimates. Actual costs are calculated based on AI token usage and may vary slightly from the displayed estimates.
- All payments are processed by Shopify. We do not collect, process, or store your payment card information.
- Power Use (metered billing): When enabled, overage credits beyond your plan balance are billed automatically at a surcharge rate. Usage charges are non-refundable.
5. AI-Generated Content
- No guarantees. AI-generated content (text, images, alt text, SEO metadata) is produced by third-party AI models. We do not guarantee the accuracy, quality, appropriateness, or fitness for any particular purpose of any generated content.
- Your responsibility. You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing it on your store or using it in any way. You must not publish AI-generated content without review.
- No liability for AI output. We are not liable for any damages, losses, claims, or legal issues arising from your use of AI-generated content, including but not limited to: inaccurate product descriptions, misleading claims, intellectual property infringement, offensive or inappropriate content, or SEO penalties.
- Content ownership. You own the rights to the AI-generated content created through your use of the Service, subject to any applicable third-party AI provider terms. We do not claim ownership of your generated content.
- Generated images may not perfectly represent your actual products. Product photos used as references may be interpreted differently by the AI model.
6. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you agree to the Privacy Policy.
7. Acceptable Use
You agree not to:
- Use the Service to generate illegal, harmful, defamatory, or misleading content
- Attempt to circumvent credit limits, billing, or access controls
- Reverse-engineer, scrape, or abuse the Service or its APIs
- Resell or redistribute AI-generated content as a service
- Use the Service in ways that violate Shopify's terms of service
8. Service Availability
- No uptime guarantee. The Service is provided "as is". We do not guarantee 100% uptime or uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, AI provider outages, or other technical issues.
- We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
- AI generation times may vary depending on model availability and demand.
9. Third-Party Services
The Service relies on third-party providers including Shopify, OpenRouter, Google (Gemini), OpenAI, and cloud infrastructure providers. We are not responsible for outages, changes, or issues caused by these third parties. Your use of the Service is also subject to the terms of these third-party providers.
10. Limitation of Liability
To the maximum extent permitted by law, Twyk AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, sales, or business opportunities, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Twyk AI and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your use of AI-generated content.
12. Termination
We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon uninstalling the app, your billing is cancelled and your data is deleted within 48 hours as per Shopify's GDPR requirements. Remaining credits are forfeited upon termination.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the app or email.
14. Governing Law
These Terms are governed by the laws of Hungary. Any disputes shall be resolved in the courts of Hungary.
